HIA or PIPA: Which Law Covers Your Alberta Practice?
Alberta splits health privacy in two. The Health Information Act (HIA) applies to custodians, the health professionals and organizations designated by regulation, and to the health information they hold. The Personal Information Protection Act (PIPA) applies to every other private-sector organization, including many counselling and wellness practices. Both laws are overseen by the Office of the Information and Privacy Commissioner of Alberta, both require notifying the Commissioner of breaches that create a real risk of significant harm, and HIA custodians must submit a privacy impact assessment before implementing a new system that handles health information. Because PIPA is recognized as substantially similar to PIPEDA, the federal law rarely comes into play. Does the HIA or PIPA apply to my Alberta practice?
If your profession is designated as a custodian under the Health Information Act, the HIA governs your client health records. Otherwise, your practice is an organization under PIPA. Colib supports both: the same encryption, access controls and audit logs satisfy the safeguards each law expects.
Do I need a privacy impact assessment before using Colib?
HIA custodians must submit a PIA to the Office of the Information and Privacy Commissioner before implementing a new system that handles health information. Our security documentation gives you the hosting, encryption and access details needed to complete it.
Does Colib apply GST in Alberta?
Yes, per service type. Alberta has no provincial sales tax, so the only question is whether a service carries 5% GST; many health services, including psychotherapy and counselling therapy since June 2024, are exempt, and you decide which ones are taxed.
Which Alberta colleges do Colib users belong to?
Members of the College of Alberta Psychologists, the Alberta College of Social Workers, ACSLPA, the Alberta College of Occupational Therapists, the College of Physiotherapists of Alberta and the College of Dietitians of Alberta, among others. Massage therapists and counsellors, whose professions are not regulated in Alberta, use Colib too.
