colib is an electronic health record (EHR), practice management and online booking platform provided by Colib Technology Inc. to clinics and health professionals across Canada, together with a patient portal for their clients. The platform is a tool supporting professional practice: it does not provide medical advice and does not replace the professional judgment of practitioners.
Access to the platform requires an account; you are responsible for keeping your credentials confidential, for enabling the available security features (such as two-factor authentication), and for the activity carried out under your account.
Professional users (clinics and practitioners) remain responsible for the personal health information they record on the platform: accuracy of the records, lawful basis of collection, consent of their clients, and compliance with the retention rules of their professional order.
You agree to notify Colib without delay at support@colib.io of any suspected unauthorized access to your account.
You agree not to use the platform to: access records you are not authorized to access; attempt to breach or test the security of the platform without written authorization; introduce malicious code; or use the service for any unlawful purpose. Colib may suspend an account involved in conduct that endangers the security of the platform or the confidentiality of the information it hosts.
In no event shall Colib or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Colib's website, even if Colib or a Colib authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
The materials appearing on Colib's website could include technical, typographical, or photographic errors. Colib does not warrant that any of the materials on its website are accurate, complete or current. Colib may make changes to the materials contained on its website at any time without notice. However Colib does not make any commitment to update the materials.
The protection of personal information, including personal health information, is governed by our privacy policy and, for artificial intelligence features, by our artificial intelligence page. Where the platform is used by a clinic to manage client records, the clinic remains responsible for those records and Colib acts as its service provider.
Colib takes commercially reasonable measures to keep the platform available (cloud hosting in Canada, daily backups), but does not guarantee uninterrupted availability; maintenance is carried out so as to minimize impact.
The following provisions apply where a clinic uses the online payment method made available by Colib to collect payments from its clients. In the event that a client disputes a payment and requests a refund, Colib will provide the clinic with reasonable assistance in resolving the dispute. Should the dispute be resolved in favour of the client, the clinic shall reimburse Colib for any funds withdrawn from Colib as a result of the dispute, including any dispute fees charged by the payment processor. The clinic remains entitled to subsequently request a new payment from the client for the services concerned.
Clinics may terminate their subscription in accordance with their service agreement; upon termination, the clinic's data is handled as described in the Retention and destruction section of our privacy policy. Patients may close their portal account at any time from their profile; closing the account does not delete the clinical record held by their clinic.
Colib has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Colib of the site. Use of any such linked website is at the user's own risk.
Colib may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
These terms and conditions are governed by and construed in accordance with the laws of British Columbia, Canada and you irrevocably submit to the exclusive jurisdiction of the courts in that Province or Country. Nothing in these terms limits the application of the privacy laws applicable in your province, including the Act respecting the protection of personal information in the private sector (Quebec).
